These Terms of Use ("Terms") govern your access and use of the mobile game Nomad Rush (the "Game"), including the website, mobile application, in-game services, digital content, and any associated features or interactions (collectively, the "Services") provided by the development team ("we", "our", or "us"). By accessing or using Nomad Rush, you acknowledge and agree to be bound by these Terms. If you do not accept these Terms, do not access or use the Services.

1. Eligibility and Account Registration

• 1.1 Age Requirement: You must be at least 13 years old to use the Services. Users under 18 must have parental or legal guardian consent. By using the Services, you confirm you meet this requirement.
• 1.2 Account Accuracy: You are responsible for providing accurate, current, and complete registration information. Any use of false identity or impersonation is prohibited.
• 1.3 Account Responsibility: You are solely responsible for the security of your account credentials. All activities conducted under your account will be deemed authorized by you.

2. Code of Conduct

• 2.1 Fair Play: You agree to play fairly and respect the integrity of competition. Any use of cheats, automation tools, bots, exploits, or third-party software that alters gameplay is strictly forbidden.
• 2.2 Community Conduct: You may not harass, threaten, abuse, or impersonate other players. Toxic, discriminatory, or otherwise disruptive behavior will result in disciplinary action.
• 2.3 Exploits and Bugs: You must report, and not exploit, any bugs or vulnerabilities encountered. Using such issues to gain advantage may lead to account penalties.

3. Virtual Goods & Donations

• 3.1 Donations: Nomad Rush may offer optional contributions to support the game's development. These are voluntary and not tax-deductible unless explicitly stated.
• 3.2 Virtual Items: In-game currencies, upgrades, visual assets, and access passes (including but not limited to the Nomad Elite Pass) have no real-world monetary value. All purchases are final, non-refundable, and non-transferable, except where required by local law or platform-specific policy (e.g., Google Play refund guidelines).
• 3.3 Account-bound Content: Purchased or unlocked items are tied to your account and cannot be sold, gifted, or withdrawn for real-world goods or services.

4. Content Ownership & Intellectual Property

• 4.1 Ownership: All rights, titles, and interests in Nomad Rush, including all graphics, animations, vehicles, mechanics, trademarks, audio, and gameplay systems, are the exclusive property of the development team or its licensors.
• 4.2 Restrictions: You may not copy, distribute, modify, reverse engineer, decompile, or create derivative works from any part of the Services without prior written consent.
• 4.3 User Content: By submitting suggestions, feedback, or customizations (e.g., player-submitted liveries or content ideas), you grant us a perpetual, irrevocable, royalty-free license to use, display, and adapt such content for the improvement of the Game.

5. Suspension, Termination & Enforcement

• 5.1 Violations: We reserve the right to suspend, restrict, or permanently terminate access to your account at our discretion for violations of these Terms, suspicious activity, or behavior deemed harmful to the community or service integrity.
• 5.2 Enforcement Actions: Enforcement may include temporary bans, item removal, leaderboard reset, account termination, or legal action, depending on the severity and frequency of the violation.

6. Disclaimers and Limitations of Liability

• 6.1 No Warranty: The Services are provided “as is” and “as available,” without warranties of any kind. We do not guarantee uninterrupted gameplay, performance, or compatibility across devices.
• 6.2 Liability Limitation: To the fullest extent permitted by law, we are not liable for any direct, indirect, incidental, or consequential losses resulting from your access or use of the Services, including loss of data, progress, or digital items.

7. Updates and Modifications

• 7.1 Terms Changes: These Terms may be updated periodically. If significant changes occur, you will be notified via the app or website. Continued use after any updates indicates acceptance of the new terms.
• 7.2 Game Updates: We may modify, add, or remove game features at any time without prior notice. We are not obligated to support legacy devices, mechanics, or discontinued content.

8. Dispute Resolution

• 8.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction where our team is based, unless otherwise required by your local consumer rights laws.
• 8.2 Disputes: In case of any dispute arising from these Terms or the Services, parties agree to attempt informal resolution first. If unresolved, disputes shall be settled through binding arbitration or small claims court, where applicable.
